This property is selling AS IS-WHERE IS.  There will be 10 % buyers fee added to the final bid amount.  A 20% down payment is due by bank wire or cashier’s check within 48 hours of bid closing.  In the event that the purchaser fails to close and pay his/her balance when due, the down payment shall be retained by the Seller as liquidated damages. Buyer and Seller acknowledge that the actual amount of damage sustained by the seller, in the event the buyer fails to close the subject property are impossible to ascertain; therefore the parties hereby agree upon the amount of the down payment as liquidated damages. Seller agrees to furnish at seller’s expense a standard form Owner’s Title Insurance Policy issued by a company qualified to insure titles in Alabama in the amount of the purchase price. Seller shall have a reasonable time within which to cure any defects in title. Seller agrees to pay for the expense of the Owner’s Title Insurance Policy and Deed preparation fee. All other expenses at closing, including ad valorem taxes shall be paid for by the purchaser.
